Advice for tenants

Renting a home is an exciting step, and being prepared helps ensure a smooth and stress-free experience. Understand the process of renting a property in the UK, including your rights and responsibilities as a tenant, by reading the government’s How to Rent’ guide. This essential guide provides important information on tenancy agreements, deposits, repairs, and what you can expect from your landlord or letting agent.

The Tenant Fee’s Act 2019

The Tenant Fees Act 2019 is UK legislation designed to make renting fairer and more transparent for tenants. It restricts the fees that landlords and letting agents can charge in connection with a tenancy.

Holding Deposit -

To secure a property, a holding deposit equivalent to one week’s rent is payable once the landlord and tenant agree to proceed. This amount will be credited towards the first month’s rent upon successful completion of referencing and the tenancy agreement. The holding deposit may be retained if the tenant:

  • Provides false or misleading information that results in failed referencing
  • Fails a Right to Rent check.
  • Withdraws from the tenancy.
  • Fails to take all reasonable steps to enter the tenancy within the agreed timeframe.

Retention of the holding deposit will be in accordance with the Tenant Fees Act 2019.

Security Deposit –

A tenancy deposit is payable prior to the start of the tenancy and is capped as follows:

  • Five weeks’ rent, where the annual rent is below £50,000
  • Six weeks’ rent, where the annual rent is £50,000 or above

The security deposit will be protected in a government-approved Tenancy Deposit Scheme for the duration of the tenancy.

Rent Collection

All individuals aged 18 or over who will be living at the property must be named on the tenancy agreement and provide valid documentation to confirm their Right to Rent in the UK. Right to Rent checks are a legal requirement and must be completed before the tenancy can commence.

Referencing

As part of the application process, all prospective tenants will undergo referencing. This typically includes credit checks, employment verification, and previous landlord references to confirm affordability and reliability. Referencing helps ensure the tenancy is suitable for both the tenant and the landlord.

Move-In Monies

Once satisfactory referencing has been completed, you will receive a payment breakdown detailing all outstanding monies due to Brown & Hart prior to move-in. All funds must be received as cleared funds before the tenancy start date. Please note that we only accept payment via bank transfer or via your tenant portal that will be set up for you in advance.

Charges during your Tenancy

Rent Arrears Charges

If rent remains unpaid for more than 14 days, interest will be charged at 3% above the Bank of England Base Rate, calculated from the date the rent became overdue until payment is received. This is in line with the Tenant Fees Act 2019.

Lost Keys / Security Devices

Charges for the replacement of lost keys or security devices are as follows:

  • Standard Key – £20.00
  • Specialist Door Key – £30.00
  • Key Fob – £60.00 (including VAT)

Charges reflect the reasonable cost of replacement.

Change of Sharer / Tenancy Amendments

A fee of £50.00 inc. VAT is payable for amendments to the tenancy agreement, including change of sharer, subject to landlord approval.

Early Termination of Tenancy

If a tenant requests to end the tenancy early, this may be agreed at the landlord’s discretion. The tenant will remain liable for rent until a new tenant takes occupation and will be responsible for the landlord’s reasonable re-letting costs. These costs must be paid in advance.
